1. Overview & Statutory Authority

American Health Plan (“we”, “us”, or “our”) takes consumer privacy and federal telecommunications compliance seriously. This TCPA & Calling Consent disclosure details your rights under the Telephone Consumer Protection Act of 1991 (TCPA), 47 U.S.C. § 227, the Federal Communications Commission (FCC) regulations, and the Telemarketing Sales Rule (TSR) enforced by the Federal Trade Commission (FTC).

Key Consumer Takeaway: Submitting an online request for health or Medicare plan quotes gives our licensed agents and contracted insurance partners permission to contact you by phone, automated dialer, text, or email to discuss your options. You are never obligated to buy anything, and you can revoke your consent at any time.

2. Express Written Consent Defined

By providing your telephone number (wireless or landline) and clicking buttons such as “Find My Medicare Plans”, “Get Free Quote”, or “Submit & View My Plans” on americanhealthplan.us, you provide your explicit affirmative electronic signature and express written consent to be contacted by American Health Plan and our licensed Marketing & Carrier Partners.

This consent applies even if your telephone number is currently registered on any state, federal, or corporate Do Not Call (DNC) registry list.

3. Telecommunications Technologies Used

You agree that communications initiated pursuant to this consent may be delivered via:

  • Live telephone calls from licensed health and Medicare insurance agents.
  • Automated telephone dialing systems (ATDS) or predictive dialers.
  • Artificial voice, prerecorded audio messages, or conversational voice AI technology.
  • Short Message Service (SMS), Multimedia Messaging Service (MMS), and push notifications.
  • Electronic mail (email) containing requested quotes and enrollment documentation.

4. Consent is NEVER a Condition of Purchase

Your consent is completely voluntary. Agreeing to receive automated calls, texts, or marketing messages is NOT a requirement or condition to purchase any property, goods, or services from American Health Plan or our partner carriers.

If you prefer to explore insurance coverage without consenting to automated outreach, you may email our team directly at hello@americanhealthplan.us or mail your inquiry to our Austin, TX headquarters.

5. Who May Contact You

Communications authorized by this consent will originate from American Health Plan or one of our licensed, vetted insurance distribution entities and underwriting carrier partners. For a comprehensive, regularly updated directory of participating entities, please review our Marketing & Carrier Partners List.

6. Message Frequency & Mobile Carrier Rates

  • Frequency: Message and call volume varies based on your inquiry and enrollment status. Typically, members receive 2 to 4 informational messages following an initial quote request.
  • Costs: American Health Plan does not charge consumers to receive SMS updates. However, standard message and data rates may apply depending on your cellular carrier plan (AT&T, Verizon, T-Mobile, etc.).

7. How to Revoke Consent (Opt-Out at Any Time)

You maintain the right to revoke your calling and messaging consent at any point in time through any of the following convenient methods:

  • Text STOP: Reply “STOP”, “END”, “QUIT”, “CANCEL”, or “UNSUBSCRIBE” to any text message received from us. You will receive an immediate confirmation text.
  • Verbal Request: Inform the licensed advisor during any phone call that you wish to be placed on our internal Do Not Call list.
  • Online DNC Request: Submit your phone number through our Do Not Call (DNC) Policy Page.
  • Email: Send your name and phone number to dnc@americanhealthplan.us with the subject “Revoke Consent”.

Revocation requests are typically processed within 24 to 48 hours, and no later than the 10 business days mandated by federal regulation.

8. Audit Logs & E-SIGN Act Compliance

In adherence to the Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. § 7001) and TCPA compliance protocols, American Health Plan securely logs digital proof of your consent. Captured records include IP address, timestamp, referral URL, browser user agent, and a photographic or cryptographic screenshot token documenting the exact disclosure language shown at the time of submission.
